Terms of sale
Draft. This text will be reviewed by a lawyer before sales start.
This English version is provided for convenience. In case of doubt, the German version prevails.
1. Scope and contracting party
Trendform Audio is a brand of Trendform GmbH, Bergweg 9a, 82399 Raisting, Germany (“we”). Our plugins are sold by Paddle.com Market Limited (“Paddle”) as reseller. The purchase contract is concluded between you and Paddle, and Paddle’s buyer terms apply to the purchase: paddle.com/legal/checkout-buyer-terms. Paddle processes the payment, issues the invoice and handles sales tax.
These terms additionally govern the relationship between you and us: license, activation, updates, support and our voluntary refund promise. Use of the software is also governed by our license agreement (EULA).
2. What you get
After payment you receive a license key by email and access to the installers on our download page. The license does not expire and covers the major version you bought. The number of computers you can activate at the same time is stated on the product page.
Before buying, you can test every plugin without restrictions for 7 days. Please use this time to check that it runs in your setup. System requirements are listed on each product page.
3. Prices
All prices shown are final prices including statutory VAT. Depending on your country, Paddle recalculates tax in the checkout, and the amount shown there applies.
4. Right of withdrawal
Consumers have a statutory right of withdrawal towards Paddle. For digital content it expires once you expressly agree that performance begins before the withdrawal period ends and acknowledge this. Details are set out in Paddle’s buyer terms.
5. Voluntary refund
Independently of the right of withdrawal, we refund the full price within 14 days of purchase, no reason required. Write to support@trendform-audio.com or reply to your order email. The refund is issued by Paddle to the original payment method. Refunded licenses are deactivated.
6. Updates and support
Updates within the major version you bought (for example 1.0 to 1.9) are free. We may charge an upgrade price for new major versions. Support is provided by email in English and German, usually within two working days.
7. Warranty and liability
Statutory provisions apply. We are liable without limitation for intent and gross negligence, for injury to life, body or health and under the German Product Liability Act. For slightly negligent breaches of essential contractual obligations, our liability is limited to the typical, foreseeable damage. Otherwise, liability for slight negligence is excluded. Please back up your projects regularly.
8. Final provisions
German law applies, excluding the UN Convention on Contracts for the International Sale of Goods. For consumers, this choice of law only applies insofar as it does not deprive them of the protection of mandatory provisions of the country in which they habitually reside. Should any provision be invalid, the remaining provisions remain valid.
